These Terms of Service ("Terms") govern your use of the Simbi website, support pages, and related services operated by Matthew Smart ("Simbi", "we", "us", or "our").
If you use the Simbi iOS app downloaded from the Apple App Store, your use of that app is also subject to Apple’s Standard End User License Agreement (EULA), available here:

1. Eligibility and parental responsibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account, purchase a subscription, or otherwise use Simbi as a parent or guardian.
Children may use Simbi only with the knowledge, consent, and supervision of a parent or guardian. The parent or guardian is responsible for deciding what information is entered into the Services and for supervising a child's use of the Services.
2. About Simbi
Simbi provides personalised bedtime stories, story themes, child profile features, character customisation, optional audio narration, and related features.
We may add, remove, change, improve, suspend, or discontinue any part of the Services at any time, with or without notice, where reasonably necessary.
3. Accounts and access
To use certain features, you may need to create or access a family account or use other access methods made available through the Services.
You are responsible for:
- providing accurate information
- maintaining the confidentiality and security of your account or access credentials
- all activity that occurs through your account or connected family setup
- ensuring that only authorised members of your household use your account features
You must not impersonate another person, access another user's account without permission, or use the Services in an unlawful or unauthorised way.
4. Licence to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial use only.
This licence does not give you any ownership rights in the Services or any part of them.
5. Acceptable use
You agree not to:
- use the Services in violation of any applicable law or regulation
- submit, upload, or transmit harmful, abusive, infringing, unlawful, or otherwise objectionable content
- attempt to reverse engineer, decompile, disable, disrupt, or interfere with the Services
- attempt to gain unauthorised access to our systems or another user's account
- use the Services to generate inappropriate, exploitative, sexualised, violent, or otherwise unsuitable content involving children
- misuse free trials, offers, subscriptions, family features, join codes, or promotional benefits
- use the Services for commercial purposes unless we expressly agree otherwise in writing
We may investigate misuse and may suspend, restrict, or terminate access where reasonably necessary.
6. User content
You may provide prompts, profile details, preferences, saved items, support messages, and other content through the Services ("User Content").
You retain ownership of any rights you have in your User Content. However, you grant us a limited, non-exclusive, worldwide licence to host, store, reproduce, process, adapt, and use that User Content solely as reasonably necessary to operate, provide, maintain, improve, secure, and support the Services.
You represent and warrant that:
- you have the rights and permissions needed to provide any User Content you submit
- your User Content does not violate any law or the rights of any third party
- any information you provide about a child is provided by or with the authority of a parent or guardian
7. AI-generated content
Simbi uses automated systems, including AI and voice generation tools, to create stories, narration, and related outputs.
While we aim to provide high-quality, family-friendly content, AI-generated output may sometimes contain errors, unexpected phrasing, inaccuracies, or results that do not match your preferences. You are responsible for reviewing generated content before sharing it with a child.
We do not guarantee that generated output will always be accurate, suitable, uninterrupted, or available.
8. Subscriptions, purchases, and billing
Certain features of the Services may require a paid subscription or one-time in-app purchase.
If you purchase through Apple, billing is processed by Apple and is subject to Apple's terms, conditions, and policies. We do not control Apple's billing systems.
Subscription prices, billing periods, trial terms, and included features will be shown to you before purchase.
Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period, in accordance with Apple's rules. You can manage or cancel your subscription through your Apple account settings.
We may change pricing, plans, trial offers, or available features at any time to the extent permitted by law.
9. Refunds
Where purchases are made through Apple, refunds are handled by Apple in accordance with Apple's applicable policies. You should contact Apple directly for refund requests relating to App Store purchases.
10. Intellectual property
The Services, including the app, software, technology, branding, names, logos, design, text, graphics, interfaces, and other materials made available by us, are owned by or licensed to us and are protected by intellectual property and other applicable laws.
Except as expressly permitted in these Terms or by law, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, or exploit any part of the Services without our prior written permission.
11. Personal and family use
Simbi is provided for personal, family, and non-commercial use only unless we expressly agree otherwise in writing.
12. Availability and changes
We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
Features, content, and availability may vary by device, operating system, region, language, platform, or subscription plan. We may update or modify the Services from time to time.
13. Suspension and termination
You may stop using the Services at any time.
We may suspend, restrict, or terminate your access to all or part of the Services if:
- you breach these Terms
- you misuse the Services
- we reasonably believe suspension is necessary to protect users, the Services, or third parties
- we are required to do so for legal, regulatory, security, or platform-related reasons
If your access is terminated, the rights granted to you under these Terms will end immediately. Provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, liability, indemnity, and governing law.
14. Limitation of liability
To the maximum extent permitted by law, the Services are provided "as is" and "as available". We disclaim all warranties, representations, and conditions except those that cannot legally be excluded.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or other intangible losses arising out of or related to your use of, or inability to use, the Services.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Matthew Smart from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- your misuse of the Services
- your User Content
- your breach of these Terms
- your violation of any law or the rights of a third party
16. Governing law
These Terms are governed by the laws of England and Wales, except to the extent that mandatory consumer protection laws in your country of residence apply and cannot be excluded.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate.
Your continued use of the Services after updated Terms take effect means you accept the revised Terms.
